Got new muse album today and what a disappointment. I love their new tune supermassive black hole, and their last 2 albums were e4xcellent (origins of symmetry, and Absolution). Shame really. So no I do not recommend u buy this album.

It's my 18th in exactly 2 weeks, YAY I cannot wait, another excusae to go clubbing and get drunk, and yes, I will try take some pics of that too.

On the whole been pretty chilled after my A levels, I hope to god they went well so fingers crossed eh!

Found out today we will be moving probably 1st or 2nd week in August so MAY be offline for a while which is a shame as I like coming on here and p**sing you all off. Ahh well tough s##t, you will have to live merrily for a week or so!

I have 3 exams on monday and then thats half of them already done And I also have wednesday, friday and the 28th left when I have exams so not tooo stressed really.

Other than that all is well, Ill try keep this updated. Got some important events coming up soon. Firstly the cheque still hasn't cleared thus I can't pick up my car yet and i'm really annoyed as I was all excited about getting it.
Secondly I am having to sleep on the sofa this week as family are down and in my room and the sofa is ****ing TINY, my head is hanging over one side and my legs hanging over the other. Plus its hard to egt into a comfy position thus ive had too little sleep.
Thirdly Honda are being twats and not working hard enough to catch up with Renault. They should be developing new parts and engine upgrades instead of just focusing on getting the set up perfect!

Rant over now. European GP on this weekend YAY and also I will have my car by then so I can go out cd player shopping and fixing it in. (I'm pretty handy when it comes to DIY and electrics.)
Err dunno whatelse to say really, Weather has been lovely today and im now outside in the garden tapping away on my laptop soaking up the sun so ill have a nice tan now

errr,, righty ho, well Ill try keep this updated more often and the new drinking season will be starting shortly so hopefully there will be plenty of stories to tell you all of the drunken adventures, this is now going to be my 3rd year of beach parties, its quite nice, and im still not 18! well I am in 2 months so YAY

I went to the a1gp at Brands Hatch on sunday! We were at druids and had a good view of both paddock hill bend and graham hill bend too! The sprint race and extra races weren't all that great but the feature race was brilliant and most of the overtaking took place right where we were

Also this week i have been extremely Ill, I have been diagnosed with a type of tonsillitis apparently called phlaryngitis! I also have my sinus infection that i seem to permanently have, and to add onto that i hjave bene having trouble in my left knee where I have a cartilidge problem! LOL! Lucky me!

My new job at Tesco's is going well though, and I have got the hang of the till's and lotto machine .

Today we were doing about the Mens Rea of Recklessness. For those of you who do not know the basic concepts of criminal law heres a quick intro... ''Actus non facit reum nisi mens sit rea'' Roughly translated... ''An act does not make a person legally guilty unless the mind is legally blame worthy also.'' Actus reas is the act or failure to act in some cases (an omission) and mens rea is the mind! Basically!

Today we did about recklessness, now to define recklessness is very difficult as each legal definition is both right and wrong. for example, ''not taking due care'' This is a little simple and could be interpreted so much that it could end up also defining negligence! The most accurate definition really is '' an act (or omission) that carries a risk that certain consequences will result, but the defendant nevertheless goes on to take that risk'' Again this is still not a complete definition, but the best one legally!

We then went onto the two types of assesing recklessness, and this is where it gets mind boggling. Fpr years there were two tests, subjective and objective! This caused many problems, to name a few...
-law unsure of definitions
-unsure when to apply
-the tes for Objective recklessness was a mixture of subjective and objective!

The first case to establish a subjective test was R v. Cunningham (1957) who was charged with an offence under s23 OATPA 1861 (offence against the person act). The Crown court had to establish somthing in the statue, 'statutory interpretation' is the correct name for it but concluded cunningham was guilty. The court of appeal however aquitted him a the work interpreted was not relevent and they took a subjective view and said that recklessness should be assesed with subjective tests!

However in MPC v Caldwell (1981) an objective test was taken yada yada yada and the house of lords used the practice statement to oiverturn the subjective test but didnt over rule the decision in Cunningham leaving Recklessness with two tests, which was undesirable.

Now along comes the 2003 case of R v. G (a child so the name is not allowed to be published) and obviously an objective view was taken and the kids were charged with under s2 Criminal Damage Act, they appealed to CofA who just confirmed the decision, so again an appela took place in the hopuse of lords who realised that 2 11 year olds couldnt forsee that seting alite some newspaper under a huge industrial wheelie bin would result in the row of shops burning down, so the subjective view was taken and again the practice statement was used and now the law states recklessness cases must be decided using subjective tests.

this is a very very dumbed down version because what I did today took 10 pages full of notes!




On another topic now, JB has been confirmed as the 2006 BAR n1 driver so happy news there for me. Im also currently searching for a fancyt dress costume for my mates 18th on october the 10th! Im gonna go as a 70s disco dancer with a huge afro and flares and platforms and everything.

I decided to go to the cafe to get a can of coke as the vodka wasnt nice, LOL, and to mix it up a bit more. However while walking back to the beach from the cafe i was walking on some stones and one sliced up my foot, i didnt notice at first and when i got back there was blood in the sand and i looked at my foot to find it sliced. Then, my mate who was also still sober was pushed and stood on the disposable barbecue, and so we both left in much pain and couldnt walk. So today has been very rubbish!
