If it was illegal it would be breaking a rule, not exploiting a loophole. Perfectly legal and as far as I'm concerned as much a part of motor racing as anything else.

The whole point was the basis of Ferrari's argument against the diffuser meant they were effectively calling their own previous cars illegal too. It's part of Ferraris shoot-foot policy.
