Posted this on the forum on my game, but seen as im on here a couple of times a day thought id check here too!

Hey,I wonder, are there any insurance experts here? graphicsforumsmile.gif I had an accident Sunday early afternoon whilst on a driving lesson, my pupil and I were perfectly in the right, as far as I can see, but I've decided to document the entire thing on here, if nothing else but to vent frustration!

The picture below shows the line been taken by myself and the other vehicle, im in the car travelling on the black line, the other line is for the other vehicle.

We set off heading straight on, second exit, and as is the custom in England, if no road markings are shown you should use the left hand lane. So off we go, we get going, get up to around 20 mph, 2nd gear and accelerating, the *whoosh, bang* another vehicle comes around the right hand side and smacks the front of my car, causing approx

Inform the police that the guy was driving with no insurance. you should have called them at the time of the incident if he was not prepared to give you ihis insurance details. Obtaining cover after the accident will mean that no insurance company will pay out on hi behalf. I predict that you will have to pay your excess and claim off of your own insurance.

Carry a baseball bat with you next time and escort them to the cash point.

On the other note, the processes I have read show that the guy will be sued twice, the first from the MIB, which is the body responsible for uninsured drivers, they will pay my insurance company the funds to fix my car and recover the costs from the guy.

Secondly my insurance company will sue the guy for the excess I had to pay.

But yes, I think either way I will be paying up my excess to start with!

If I interpret the picture properly then it looks to me that your pupil shouldnt have pulled out from the roundabout (unless, the other drive entered from the same direction as you did), since they had a car on their right that they would have caused to slow down, meaning your car effectively cut them up. Wouldnt they have failed a driving test by putting another car in a position to have to slow down?

Going on that it would appear to me that it wasnt the other guys fault. Unless of course he was speeding, but doing a roundabout at +30mph is pretty rare.

I've never quite understood why its considered correct to go straight through in the left lane, as its just kinda asking for things like this to happen. If people use the right hand lane for everything other than turning left then not only does it mean that people exiting dont have to cross their path, but also means that the left lane is always free for people who are just wanting to turn left at the first exit. Also (in a situation with 2 on and 2 off) if people only used the left lane for turning left then people could use the right lane to turn left as well (exiting in the right lane), since nobody in the left lane would ever go past the first exit.

I'm just curious as to why it is the way it is as I can't think of any advantages to people using the left lane to go straight on.

From your picture i can imagine what happend . Your pupil had right of way , this arsehole ( probably speeding ) tries to overtake you ilegally. ( because he see's a learner driver and wants past)

You were In the right lane to go ahead and plus you can't overtake on a round about, he's to blame basically. If he hit you from behind he has no case :-)

The fact that he didn't have insurance tell's you what kind of person he Is. You should of called the police ^^

To clarify, the other driver was not present at the time of us entering the round about, what I would say is that we were well established (well in to the round about, far from the entrance we pulled out from), meaning we couldnt have just pulled out in front of them.

Left lanes been left only is another wide ranging subject, you would avoid accidents such as this, but then you would have more accidents where people pull in to the empty left lane to go left, when you are also pulling off at the same exit and so nearly ends in a collision as you pull across the lane to exit with them at the side... (I find this also happens at least once a day, learners tend to go at around 20 mph on round abouts, where as others pull on and end up right beside you, I just have to keep a good eye on my blind spot mirror and hope they see our left indicator applied - although they were bad enough to pull out in the first place so I hold little in the way of actual hope!).

lol at the other comments, they can claim racism if they wish, I teach and have taught enough people from all varieties that im sure I can build a good character reference!

You are right in that your insurance company will do most of the running for you and that you will have to pay the excess first and claim it back... BUT watch out for:

1) Ensure you do get the excess back as insurers can sometimes be slow to do this - you will need to chase

2) You will probably lose your no-claims bonus initially, but then will get it reinstated if the other driver is proven to be at fault. This is important as it will push up your premiums. Ensure you get a refund for any extra premiums that they charge you in the interim.

3) If the other driver is at fault, ensure that on your insurance company records they list it as a "non-fault" claim. When approaching new insurers in future also ensure that when they ask if you have any claims that you list this as a non-fault claim. If you don't they will load your premiums.

Small bits of advice but this can save you thousands.

Contacted all relevant companies today, they have seperate legal team for recovering the cost of my repairs, seemed easy enough to do too!

How do you know? What if I'm a Pakistani/Paki/whatever who is just studying abroad in the US?

Okay, fine, so the fact I don't know what to call a person of Pakistan nationality proves I'm not one.

If anyone was a Pakistani on the forums; they would have participated in the Cricket topics, esp for the 20/20 final match which India WON.....

btw, Paki is sometimes felt interesting to Pakistanis and the correct term, i think, is Pakistani....
